Consulty Terms of Use

These terms govern accounts, bookings, payments, and use of the platform. By using Consulty, creating an account, or confirming a booking, you agree to them.

1. Marketplace role

Consulty is a technology marketplace facilitating contracts between clients and independent consultants. Consultants are not Consulty employees or agents unless expressly stated. No particular business, legal, financial, or technical outcome is guaranteed.

2. Accounts and eligibility

Users must provide accurate information, secure their credentials, and supply identity or authority evidence when requested. We may restrict accounts for risk, suspected fraud, or breach.

3. Bookings and payments

Prices, platform fees, and applicable taxes are displayed before payment. Third-party processors handle payments and may delay or reject transactions for compliance reasons.

4. Non-circumvention

Clients and consultants must not move communications, payment, or work off-platform to avoid fees where the relationship originated on Consulty. This restriction applies during the relationship and for 24 months after the last platform interaction. We may suspend accounts and recover avoided fees, actual losses, costs, and legally available remedies.

5. Intellectual property

Consulty retains rights in its platform and brand. Unless agreed otherwise, client ownership of bespoke deliverables transfers only after full payment; consultants retain pre-existing tools and grant the licence necessary to use the deliverables.

6. Liability

To the maximum extent permitted by law, Consulty is not liable for indirect loss, lost profit, opportunity, or data arising from an independent consultant service. Aggregate platform liability is capped at platform fees paid by the claimant in the preceding six months. Mandatory consumer rights remain unaffected.

7. Suspension and termination

We may restrict or terminate access for fraud, circumvention, unlawful conduct, security risk, disputes, or breach of these terms.

8. Governing law

UAE law governs. Parties will first attempt good-faith resolution for 30 days, after which Dubai courts have jurisdiction unless mandatory rules require otherwise.
